Limited Offset
A loss from the sale of real estate can only be offset against real estate betterment gains – not against other capital gains or ordinary income. The loss can be carried forward for 7 years (not indefinitely like other capital losses).
Non-Recognized Losses
A loss from the sale of a residential apartment that was exempt from betterment tax (single apartment exemption) is not recognized for tax purposes – it cannot be used to offset other gains.
